These unique styles included weapons, catching and striking just as creature shapes that got joined into various segments and sub styles of the workmanship. In 1500's the Portuguese, drove by traveler Pedro Alvares Cabral, showed up in Brazil. One of the primary estimates taken by the fresh introductions was the vanquishing of the neighborhood populace, the Brazilian Indians, so as to permit the Portuguese slave work (for sugarcane and cotton). The involvement in the Indians was a disappointment. The Indians rapidly passed on in imprisonment or fled to their close by homes. The Portuguese at that point started to import slave work from Africa. On the opposite side of the Atlantic, free people were caught, stacked onto slave ships and sent on bad dream journeys that would end in servitude. The Africans previously showed up by the hundreds and later by the thousands (around 4,000,000 in total).Three significant African gatherings contributed in huge numbers to the slave populace in Brazil, the Sudanese gathering, made to a great extent out of Yoruba and Dahomean people groups, the Mohammedanized Guinea-Sudanese gatherings of Malesian and Hausa people groups, and the Bantu gatherings (among them Kongos, Kimbundas, and Kasanjes) from Angola, Congo and Mozambique. The Bantu gatherings are accepted to have been the establishment for the introduction of capoeira. They carried with them their way of life; a culture that was not put away in books and historical centers however in the body, brain, central core. A culture that was transmitted from father to child, all through ages. There was candomble', a religion; the berimbau, an instrument; vatapa, a nourishment; and numerous different things. The Dutch controlled pieces of the upper east somewhere in the range of 1624 and 1654. Slaves made strides towards reconquest of their opportunity when the Dutch battled against the Portuguese settlement, attacking towns and manors along the northeastern coast, focusing on Recife and Salvador. With every Dutch attack, the security of the estates and towns were debilitated. Many, in the wake of getting away, established autonomous towns called quilombos. The quilombos were critical to development of capoeira. It likewise created fearlessness in individual capoeira specialists. Capoeira made little, firm gatherings. It additionally made hazardous and coordinated contenders. Here and there the slaves would harm themselves during the capoeira, which was not attractive from an efficient perspective. The bosses and regulators were presumably not as cognizant as the lord and his erudite people of his court of these thought processes, yet even still, they realized something didn't appear to be correct. Describe Copyright Law and Fair Use Issues in Education - 7150 Words

Describe Copyright Law and Fair Use Issues in Education (Research Paper Sample) Content: NameTutorCourseDateCopyright Law and Fair Use Issues in EducationIntroductionDefinition of Fair UseFair use can be defined as any form of copying copyrighted material for transformative or limited purposes, such as for criticism, parody, or commenting on a copyrighted work. It is sort of a defense against claims of copyright infringement and if one qualifies for fair use, it will not be deemed as illegal infringement. In the US, provisions of sections 106A and 106, fair use of a copyrighted work such as news reporting, teaching (including photocopying or reprinting many copies for students use), commenting, research, scholarship and criticism, is not deemed as an infringement of copyright. These were given by the courts in 1961 under the report of Copyrights on the general revision of the U.S copyright Law. Factors considered in determining whether a work is fair use include: * The nature of the specified copyrighted work * Purpose and use (including the character of usage). This will include clarification on whether use was for nonprofit purposes in education or of commercial nature. * Extent and sustainability of the portion used with regard to the specified copyrighted work * The effect of usage on the copyrighted works market and valueTherefore, when obtaining permission to seem impracticable in some cases, use of copy righted material should be limited or avoided unless fair use would apply to that situation. Moreover, a Copyright office cannot be in a position to determine whether a certain use is considered fair or not and cannot also advice a party on any possible violations (Merges and Lemley 18). Attorney are the ones to deal with such scenarios.Purpose and UseFour factors are normally used to determine the purpose and use of copyright under different circumstances and consequently whether fair use existed under those circumstances. They are discussed below:Purpose and Nature of the Copyrighted WorkFair use is generally used to determi ne whether work containing unauthorized copyright material is subject to copyright law more so for creation of artistic tendencies that enrich the public. Two issues are at hand here: If the infringement is new and used for commercial or nonprofit purposes and whether the new use is transformative. If the latter is the case, it will be deemed as exploitative and unfair. Therefore, the commercial and nonprofit distinction is very crucial.Commercial uses include issuing of copyrighted materials for sale, using such materials for campaigns, or displaying the materials on websites to attract viewers. Even without the factors in the latter statement, repeatedly copying and exploiting copyrighted works is also considered as commercial use. If use is noncommercial in nature, it is more likely to be acceptable under fair use policy. This holds as long as they do not deviate from the original profits of the artist. The latter is important for knowing the motive of using the copyrighted mater ial. The profit and nonprofit distinction is important not for knowing if the sole motive for the use is monetary gain, but for knowing if the infringing user has a chance of profiting from the copyrighted material without paying the customary price (Merges and Lemley 21).Transformative and superceding purposes are also looked at under copyright law. For example, the more an individual adds something new to the copyrighted material, the less likely it is to be considered copyright. The converse is also true. A very good example explained by the latter statement is the case American Geophysical Union v Texaco Inc., 60 F.3d 913 (1995).Case Example: American Geophysical Union v Texaco Inc., 60 F.3d 913 (1995).The court ruled that the photocopying of individual articles by a Texaco student was not fair use even though it was for his own research. The court amended its opinion to that of systematic copying that was to advance profit goals of the larger organization (Lerner and Poltorak 9 1).Purpose: The purpose was to strengthen Texacos profits, even with the consideration that it was for research purposes. Exact photocopies are not considered transformative at al since they do not add on to anything valuable in the original work.Nature: The nature of the articles were factual, which is in favor of fair use as stated before.Amount: The article was independent and therefore the photocopying was copying the whole copyrighted work.Effect: The court concluded that the photocopying was directly competing with the ability of the original publishers to collect legal fees.Superceding an original document is more likely to fall under exploitation since there is very little transformation being done in the original work. Parodies, for example, are considered transformative. They shed light on an original document and create a new one in the process.Nature of the Copyrighted WorkIt is to note that copyright protection is only viable for creative works and expressions rather th an bare facts or ideas. Therefore, if a certain copyrighted work is factual in nature, then the purpose for using it should also be the same, in most cases. Therefore, reuse of the work is generally fit and considered as fair usage (Merges and Lemley 26). This does not apply if the work is not yet published or released for public appearance. Since the author of any work usually controls the timing of release, any information copied from the same is not considered fair use and is actually a violation. In an educational article for example, the facts in the book may be reasonably copied to generate a separate document. This applies to only facts that are known to the general public and recognized by various institutions. On the other hand, the more fictional and creative a copyrighted material is (such as fiction novels, or animations), the more their unauthorized use is less likely to be considered fair. The Portion UsedThis has to do with the amount of original work that has been incl uded in the new/resulting document. If the amount copied is more from the original work, it is less likely to be considered as fair use. This includes photographs. For example, posting an original photograph that is copyrighted somewhere on the internet is not considered fair use, unless in very rare conditions.Case Example: Cariou v Prince,_F.3d_(2d Cir. 2013)The court rules in favor of the defendant (Prince). The plaintiff sued him for reasons involving copyright of photos he took while living with Rastafarians in Jamaica. Prince on the other hand, did include many photos in of Carious original photos in his work in 30 collages. However, since the works were transformative in terms of size, aesthetics, and expression, it qualified for fair use. The first district court ruling was in favor of Cariou. On amendment, the court found that secondary use many constitute fair use even if used for purposes other than commenting, criticism, teaching, research and scholarships. It found that the new work had altered the original one with new meaning, expression, and message (Lerner and Poltorak 93).Quality and importance of the material is also looked at in this case. The more important a section/portion is to the original work, the more likely the resulting document is exploitative, no matter how small that part is. Moreover, no distinct measures of quantity are in existence when it comes to the law. Quantity is measured according to the amount needed to serve a particular objective and the length of the original document. Therefore, for pictures, it creates a lot of controversies since users, according to the law, usually want the full amount or rather the full image. This occurs even in short movies or clips where the small creative elements might be borrowed.Case Example: Maxtone-Graham v. Butchaell, 803 F. 2d 1253 (2d Cir. 1986), Cert. Denied, 481 U.S. 1059 (1987).In this case, the plaintiff wrote a book about interviews in which women talk about their abortions a nd pregnancies. Downtown Chicago A Large Percentage Of African American...

Take Chicago for example, Downtown Chicago has a large percentage of African-American community members who are victimized in the city every day. Chicago, in particular, has very high levels of cruel and destruction of property crime, which thus turns into violent gang activity that leads to shootings. These African American community members want to live in a safe, comfortable environment, without their children being harassed by the police. They really just want the necessities that any human would want, â€Å"steady employment, educational opportunities, respectable property values, adequate municipal transportation, air conditioning, and medical assistance† (Crank). More importantly, these families want their children to go to college so they can get away from this kind of lifestyle. Community members do not ask for this way of life. These members living under these circumstances do not do so under personal choice. No African American chose to grow up their kids in poverty because they thought it would satisfy criminal careers, or because they thought a life of poverty seemed acceptable. More importantly, these members did not plan for their children to grow up with an obligation to join gangs, and get shot, or because they wanted to go out begging for money for their children’s funerals that they couldn’t afford, or even because they wanted to experience desperation or hopelessness for the rest of their lives. The Interpretation of Act V Scene I Essay Example For Students

The Interpretation of Act V Scene I Essay The Twelfth Night is a Shakespearean romantic comedy that is filled with plenty of humor and lots of deception. It is frequently read as a play about masking, about the conscious and unconscious assumption of false identities and about levels of self-knowledge and self-deception; this theme is played out prominently through Violas transsexual disguise (Kahn 43). The play is comprised of five acts and numerous scenes. However, I am only going to touch on one of these scenes in my paper. The scene I chose to write about is act V scene I. I chose this scene because it is the one that interested me the most, and I feel that it is also the scene with the most hidden meanings. Act V scene I, in my opinion, is a very complicated scene. I am going to discuss the part of the scene just before Sebastian enters, with Viola disguised as Cesario. Viola, in this part, is surrounded by many people all of whom think she is someone other than the person she actually is. This is where Viola/Cesario speaking to Olivia protests undoubtedly her love for Orsino by saying, After him I love, More than I love these eyes, more than my life (Twelfth Night 5.1. 134). Olivia, after hearing this, is confused and protests to Viola that they are married by saying, Whither, my lord? Cesario, husband, stay (Twelfth Night 5.1. 141)! Viola/Cesario denies this and is shocked by the accusation. Olivia continues to press the issue by getting the priest to confirm the marriage. It is at this point, when Orsino hears and believes the priests confirmation of the marriage, that I feel he expresses signs of homosexuality towards Viola whom he still believes is Cesario. Orsino becomes filled wi th anger and jealousy towards Viola/Cesario saying, Farewell, and take her, but direct thy feet where thou and I henceforth may never meet. (Twelfth Night 5.1. 166-167). At some level, Cesario is a homosexual object choice for both Olivia and Orsino; at another, a heterosexual one (Kahn 44). I believe that at this part of the scene Viola/Cesario is experiencing some form of an identity crisis. Although she is a woman who has deceived everyone into believing she is a man, she is now becoming bewildered by a strange turn of events. Shes being accused of denying having known Antonio and having beaten up Sir Toby Belch and Sir Andrew. She is being accused of acts that she has not done and has no recollection of ever doing. The reason she denies all of these wrong doings is because her brother, Sebastian, is responsible. This casts doubt in her mind as to who she really is and what is happening. Sebastian enters the scene and his entrance, in a way, relieves Viola of all the accusations she has endured. It was Sebastian who Antonio has been looking for; it was Sebastian who beat up Sir Toby Belch and Sir Andrew, and finally it was Sebastian who has married Olivia. We come to realize this when he says:I am sorry, madam, I have hurt your kinsman:But had it been the brother of my blood,I must have done no less with wit and safety. I do perceive it hath offended you:Pardon me, sweet one, even for the vowsWe made each other but so late ago. (Twelfth Night 5.1. 207-213)Antonio! O my dear Antonio,How have the hours rackd and torturd me,Since I have lost thee! (Twelfth Night 5.1. 216-218)At this point everyone is stunned not knowing who is who. In a sense, everyone feels as if they are seeing double. Its ironic since Sebastian and Viola are twins. Once Viola and Sebastian realized they were brother and sister Viola feels as though she is free to cast off her masculine disguise and let everyone know that she is really a woman as she talks about putting back on her feminine clothes or her maiden weeds (Twelfth Night 5.1. 253).Karen Greif says that the recognition of identity is at first an experience involving only the reunited twins; but, as the facts of their kinship are brought forth, the circle of awareness expands to include Orsino and Olivia. They appreciate for the first time their shared folly in desiring the unobtainable and both discover true love in unexpected forms by sharing in the recognition of the twins identities (53). Sebastian then turns to Olivia in an attempt to explain exactly what was going on and he says:So comes it, lady, you have been mistook. .u9e609bb1abead91cb54b88750d3b5134 , .u9e609bb1abead91cb54b88750d3b5134 .postImageUrl , .u9e609bb1abead91cb54b88750d3b5134 .centered-text-area { min-height: 80px; position: relative; } .u9e609bb1abead91cb54b88750d3b5134 , .u9e609bb1abead91cb54b88750d3b5134:hover , .u9e609bb1abead91cb54b88750d3b5134:visited , .u9e609bb1abead91cb54b88750d3b5134:active { border:0!important; } .u9e609bb1abead91cb54b88750d3b5134 .clearfix:after { content: ""; display: table; clear: both; } .u9e609bb1abead91cb54b88750d3b5134 { display: block; transition: background-color 250ms; webkit-transition: background-color 250ms; width: 100%; opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #95A5A6; } .u9e609bb1abead91cb54b88750d3b5134:active , .u9e609bb1abead91cb54b88750d3b5134:hover { opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #2C3E50; } .u9e609bb1abead91cb54b88750d3b5134 .centered-text-area { width: 100%; position: relative ; } .u9e609bb1abead91cb54b88750d3b5134 .ctaText { border-bottom: 0 solid #fff; color: #2980B9; font-size: 16px; font-weight: bold; margin: 0; padding: 0; text-decoration: underline; } .u9e609bb1abead91cb54b88750d3b5134 .postTitle { color: #FFFFFF; font-size: 16px; font-weight: 600; margin: 0; padding: 0; width: 100%; } .u9e609bb1abead91cb54b88750d3b5134 .ctaButton { background-color: #7F8C8D!important; color: #2980B9; border: none; border-radius: 3px; box-shadow: none; font-size: 14px; font-weight: bold; line-height: 26px; moz-border-radius: 3px; text-align: center; text-decoration: none; text-shadow: none; width: 80px; min-height: 80px; background: url(https://artscolumbia.org/wp-content/plugins/intelly-related-posts/assets/images/simple-arrow.png)no-repeat; position: absolute; right: 0; top: 0; } .u9e609bb1abead91cb54b88750d3b5134:hover .ctaButton { background-color: #34495E!important; } .u9e609bb1abead91cb54b88750d3b5134 .centered-text { display: table; height: 80px; padding-left : 18px; top: 0; } .u9e609bb1abead91cb54b88750d3b5134 .u9e609bb1abead91cb54b88750d3b5134-content { display: table-cell; margin: 0; padding: 0; padding-right: 108px; position: relative; vertical-align: middle; width: 100%; } .u9e609bb1abead91cb54b88750d3b5134:after { content: ""; display: block; clear: both; } READ: Environmental Pollution EssayBut nature to her bias drew in that. You would have been contracted to a maid;Nor are you therein, by my life, deceivd:You are betrothd both to a maid and man. (Twelfth Night 5.1. 257-261)What he basically was saying was that Olivia mistook Viola for a man and almost married a female servant. Instead, she married Sebastian who will also serve her and who is a man. Natures bias is usually regarded as a heterosexual one, but the line is actually ambiguous; natures bias (Twelfth Night 5.1. 258) can mean that Olivia followed nature in loving a woman, for a short and perhaps necessary period, before actually marrying a man (Kahn 45). Similarly, Orsino perhaps needed to see Viola as a girlish boy before he could accept her as a real and ardent woman (Kahn 45). However, the chain of events that has brought us to this point in the play has proven to be beneficial to Olivia and Orsino. Olivias mistaken marriage has already given her the right husband, and Orsinos unconscious love for Cesario has made it clear where he is to find an adoring wife (Williams JR 43). My first impression of Olivia was to categorize her as a lesbian for falling in love with Viola/Cesario. I felt this way because although Viola was disguised as a man, she was portraying the personality of a female and thats what Olivia fell in love with. As I read on through the play, my feelings on that matter changed. By the end of the play, I felt that Viola was imitating her brothers personality and that is who Olivia really fell in love with and that is the reason she stays married to Sebastian at the end of the play. Coppelia Kahns interpretation of Viola is similar to mine. He says that Viola copes with the supposed loss of her twin brother by, in effect, becoming him; when she disguises herself as a man, she is another Sebastian, her twins twin (Kahn 42). I find Orsinos expression of love to Viola interesting. He knows that Viola loves him because as Cesario she has declared her love to him numerous times Yet Orsino says to Viola, Boy, tho u hast said to me a thousand times thou never shouldst love woman like to me (Twelfth Night 5.1. 265-266). Viola re-confirms her love for him again and Orsino decides to shift his feelings of love from Olivia to Viola. Although Orsino now knows Violas secret of being a woman, he still refers to her as Cesario, her male name, which can be seen in the last line of the play. Cesario, come; For so you shall be while you are a man;But when in other habits you are seen,Orsinos mistress, and his fancys queen. (Twelfth Night 5.1. 384-387)This still adds some question of Orsinos sexuality. The fact that he claimed Viola as his mistress indicates a physical attraction to her, which leads me to believe that he was also attracted to her when he thought she was a man. Now he can openly express his interest and love for Viola because she is a woman and he no longer needs to suppress his true feelings. Types of Story Conflicts Between a Person and the Society

Types of Story Conflicts Between a Person and the Society Over the time of human being existence, the social norms changed regularly depending on the political situation, environment, culture and ideas of particular individuals. In every stage of the history, there were rules that had to be followed and if it happens so that a person brakes them, he or she gets a public or, at times, even obscure disapproval. Here where the conflict between a person and the society appears. Make sure that a person has valid reasons to oppose a society The society has its dominant views but they might be both ethical and unethical. The contradiction is a key in order to create a great plot for your story so presenting a clear reason for the action of the main character (be it a hero or anti-hero) is a must. The strong motivation of the character to confront what the society demands is important for the plot development. Heighten the stakes for noncompliance to the social norms The tension of the conflict makes the story interesting and thrilling. The higher level of emotions is displayed, the more engaging your story can be. Overwhelming odds and a perspective to pay a high price for breaking written or even unspoken social rules can create an intrigue that will make your story engaging. However, for a successful piece of writing that should not be booed, be careful and keep a wise balance between being prejudiced or too open-minded while creating the plot and main characters. Ideally, your story needs to help resolve a conflict in a real life and, in no case, to elevate it further. Enhance ‘person and society’ conflict by including the inner struggle of the main character Trying to disapprove the defined but clearly unethical social dogmas can, by itself, draw the attention and the reaction of a person who does not agree with what the society says is pretty much clear. The rules influence your well-being so as a result, you decide to confront the usual social practices. However, adding an inner conflict of the main character can bring an additional flare and interest to your piece of writing. An individual might get used to what is supposed to be correct so he agrees with what the society desires and considers the rules to be fairly reasonable. At the same time, the character can feel that he is not comfortable with the conventions, which make him unhappy. This inner struggle can enhance the ‘person and society’ conflict in your story and make it thrilling and memorable. Think of how the conflict will be resolved Pay attention to how you want to conclude your story. Figure out for yourself whether you want to have a happy ending that may suggest a probable solution, which can potentially help resolve the real-life conflict between an individual and the society. On the other hand, the conflict might be so complicated that all you can do is to give a food for thought to your readers so that they can start acting towards resolving it. James Baldwin, one of America’s foremost writers, once said, â€Å"The most dangerous creation of any society is the man who has nothing to lose.† Putting your character in the hardest conditions possible and showing how he managed to get over the obstacles can really make your story memorable. For the order and the success in the society, the conforming to the defined norms is a must. The idea behind this is to avoid chaos, which can be destructive for the society in whole. However, there always will be people who would not wish to conform and act against any social norms. Sometimes the protest is, in fact, justified, even if it is forbidden by the society, but sometimes people do indeed act inappropriately with regards to other members of the social structure. This is a human nature and we still have a lot to learn about how to properly handle the conflict without harming a particular individual while avoiding sabotaging the wellbeing of the whole society.

Definition and Examples of Agreement in English Grammar

Definition and Examples of Agreement in English Grammar In grammar, agreement is the correspondence of a verb with its subject in person and number, and of a pronoun with its antecedent in person, number, and gender.  Another term for grammatical agreement is concord. Basic Principles In English, agreement is relatively limited. It occurs between the subject of a clause and a present tense verb, so that, for instance, with a third-person singular subject (e.g. John), the verb must have the -s suffix ending. That is, the verb agrees with its subject by having the appropriate ending. Thus, John drinks a lot is grammatical, but John drink a lot isnt grammatical as a sentence on its own, because the verb doesnt agree. Agreement also occurs in English between demonstratives and nouns. A demonstrative has to agree in number with its noun. So with a plural noun such as books, you have to use a plural these or those, giving these books or those books. With a singular noun, such as book, you use a singular this or that, giving this book or that book. This books or those book would be ungrammatical because the demonstrative doesnt agree with the noun.–Jame R. Hurford, Grammar: A Students Guide. Cambridge University Press, 1994 Keeping Track of Details Agreement is an important process in many languages, but in modern English it is superfluous, a remnant of a richer system that flourished in Old English. If it were to disappear entirely, we would not miss it, any more than we miss the similar -est suffix in Thou sayest. But psychologically speaking, this frill does not come cheap. Any speaker committed to using it has to keep track of four details in every sentence uttered: And all this work is needed just to use the suffix once one has learned it.–Steven Pinker, The Language Instinct. William Morrow, 1994 whether the subject is in the third person or not: He walks versus I walk.whether the subject is singular or plural: He walks versus They walk.whether the action is present tense or not: He walks versus He walked.whether the action is habitual or going on at the moment of speaking (its aspect): He walks to school versus He is walking to school. Tricky Nouns Some nouns are commonly used with singular verbs although plural in form: Some nouns are commonly plural in usage, even though naming something singular.–Patricia Osborn, How Grammar Works. . Production Methods - Assignment Example Shaping occurs through stitching darts, which are essentially dimples that intermittently signal lower quality. Pressing darts are another type of dart used for panels, which ensure the precision of spacing and grain significance (Assembly and Finishing 54). c. Piece - During production, garments are made essentially by putting together pieces in a particular order. These pieces are major parts of subassemblies completed by joining parts during the panel phase. Examples of pieces in garment production are the front and back of an individual garment (Assembly and Finishing 55). Joining these two pieces to make the final clothing. The final clothing is the product. d. Product - This is the finished garment. A product is the ultimate outcome of the garment production process. A summary of this process is the addition of these four Ps in a sequence or equation, i.e. parts + panels=pieces and pieces + pieces=products (Assembly and Finishing 56). The four Ps are mostly vital to the sizing and fit of the product, meaning faults during any phase can affect the finished garment. 2. The system of assembly that I think works best in today’s world is PBS since it itemizes production steps into a set of separate activities. Many garment production houses today need separate machines carrying out separate functions, at different times. With the PBS, every sewing machinist has to be skilled in the appropriate strategy to a particular task (OECD 44). Garment manufacturers today seek to make the most of the output of both dedicated machinery and individual operators, which is a merit that PBS users indeed enjoy. Even though many garment assembly units use the PBS, combining them with the Modular Production System (MPS) and Unit Production System (UPS) is proving successful and cost saving. PBS users often have to deal with obstacles caused by absenteeism or varying outputs amongst operators and workers. MPS and UPS users often do not have to come

Discuss the extent to which the concept of duty of care in negligence Essay

Discuss the extent to which the concept of duty of care in negligence has developed in a manner so that both the claimant and de - Essay Example This means that tort is about a duty of care which one owed to another but failed to discharge accordingly. This is widely described in most books as negligence. This paper would examine the concept of negligence and how it affects the development of the concept of duty of care in order to ensure the fair treatment of both claimant and defendant in court cases. Concept of Neighbour In the landmark case of Donoghue V Stevenson3, the neighbourhood principle was developed. In the case, Mrs.Donoghue bought a bottle of ginger beer which was manufactured by Mr. Stevenson. After drinking it, she found that there was a snail in the bottle. Mrs. Donoghue fell ill and she sued Mr. Stevenson. The House of Lords sat on the case and held that Mr. Stevenson, being the manufacturer of the drink owed Mrs. Donoghue a duty of care. This is because it was reasonably foreseeable that failure to ensure product safety would cause another person to suffer and go through undue hardship. On the basis of this case, the concept of neighbourhood was established. Lord Atkins stated that in every action and inaction, a person must examine its implications and potentials of harming another individual who might be affected by them. Based on this, the concept of who a person's neighbour is was defined and established in law. Through the Donoghue V Stevenson case, it is established that a person owes another person a duty of care, once the neighbourhood relationship exists. This sets the parameters for the examination of tort cases. Duty of Care The neighbourhood test in the 1932 case of Donoghue V Stevenson has been modified to the basis of proximity. Proximity establishes that there was a close and sufficient relationship that made a person suffer some kind of injury from the action of another who was close enough to wield a duty of care to avoid that injury. In Caparo V Dickman4, a three fold test was developed to ascertain whether it is fair and just to impose a duty of care on a person for a given action in tort. These are: 1. The harm of the action in question must be reasonably foreseeable as in the case of Donoghue V Stevenson 2. The parties involved in the case must have a close relationship of proximity. 3. The duty of care imposed upon them must be fair, just and reasonable. Breach of Duty Once the three elements of a case are established, the court would need to establish that the duty of care was breached. And this breach is tantamount to negligence. Negligence is the failure to take reasonable care where a duty of care exists in a relationship5. Thus, the breach of a duty of care or negligence gives rise to a tortious liability and it leads to a given legal case. The breach of duty is failure to show a degree of care that a reasonable person ought to show in the same circumstances6. In other words, the breach of a duty of care creates an objective test which allows the court to measure the extent of a given act in tort. This is because, a reasonable person m ust show a certain level of basic consent for his actions. Without that, the real parameters of a case of tort cannot be defined. Thus, the test for reasonableness is important and fundamental in establishing the extent of negligence and the extent of failure. In Phillips V William Whiteley7 a woman suffered an infection as a result of her ear being pierced by a jeweller. The woman argued

Abraham Lincoln Bio Essay Example for Free

Abraham Lincoln Bio Essay Since his death in 1865, Abraham Lincoln has been immortalized as one of, if not the greatest hero in American history due to his role in ending the Civil War and abolishing slavery. He led our country through its’ darkest days and was able to prevent the south from successfully seceding and preserving the United States. Throughout history many have been called heroes, some deservedly and others not. Lincoln’s recognition as a hero is valid because of his many achievements and his leadership style. Lincoln was born in February 1809, in Kentucky. His early life was difficult, losing his mother to illness at 9 years old. The family was poor and Lincoln needed to work to help support them. As a result, he had very little formal education, but it was this hard work and humble beginnings that ignited the spark in Lincoln to learn. When he was a young man the family moved to Illinois and it was there that Lincoln learned the law and became interested in local politics. In 1834 he was elected to the Illinois State Legislature. He taught himself the law, was admitted to the Bar in 1836 and also began a career as a successful lawyer. Between 1847 and 1849 he served one term in the U.S. House of Representatives. As a result of the increased opposition to slavery, the Republican Party was born and Lincoln joined the party in 1856. It was his anti-slavery views and the continuing passing of laws to protect slavery that further sparked his interest in politics. He ran unsuccessfully for the U.S. Senate but obtain national exposure from the race due to his unique communication and debating techniques. It was this exposure that found him as a candidate for President in 1860. He was elected the 16th President of the United States and the first President from the Republican Party. Because of his well-known views on slavery, the  secessionists began their plans to split from the Union prior to his taking office. The Civil Was began in April of 1861 with the attack on Fort Sumter in South Carolina. Almost immediately in his role as President, Lincoln was faced with the most challenging situation of any President prior to him. His decision-making and communication skills, though unpopular at times, would be a vital part of his success over the next several years. Lincoln possessed strong social intelligence skills. He was sensitive to other people’s feelings and moods, and he was particularly adept at reading people. Lincoln had a great ability in understanding the motivations of others, and was skillful at getting others to cooperate with him. He knew to be pleasant and approachable while also being fierce when fighting for causes he believed in. One tool that Lincoln would use was storytelling. He would use stories from his past which would put people at ease while at the same time relaying his point in a clear way. Another method he would use was to ask questions to get his rivals to see things his way. His communication style and speeches were simple and logical. Abraham Lincoln’s most famous speech was the Gettysburg Address given in 1863 at the dedication of the National Cemetery after the battle at Gettysburg. The speech last just over two minutes and was an example of how Lincoln understood his audience. There had been much â€Å"Pomp and Circumstance† throughout the ceremony and many long speeches prior to his. The words he chose were short and to the point, but were full of inspiration and emotion. The speech focused on the principles of the founding fathers of our nation and the words from the Declaration of Independence that â€Å"all men are created equal† and that all men have the unalienable rights to the pursuit of life, liberty and happiness. One of the main things Lincoln wanted to accomplish with this speech, was to rally support for the 13th Amendment, which would abolish slavery and was in jeopardy of failing to pass in Congress. Lincoln again used his influence as a communicator to get the 13th Amendment passed. He would spend hours with his political rivals building relationships. It was important that he understood their perspectives on the issues and would give them the opportunity to express their views and needs. His approach was thoughtful and personal. This bill was met with much opposition and it took great skill and tenacity on Lincoln’s part to insure its passage. Many Presidents since Lincoln have also faced challenges when trying to pass  legislature, among them our current President Barack Obama. Whether or not you are a supporter of our current President aside, some similarities can be seen between the two. As was the case with Lincoln, Obama is known for his listening skills, and taking in ideas from all sides. He is a skilled orator and there is a strong sense of morality in his tone when speaking. There are many references to President Lincoln in Obama’s speeches which show the influence the former President has on him. Abraham Lincoln led our nation through one of its most turbulent times. He used his communication skills and understanding of people to obtain success. His ability to talk to people and understand what they stood for while moving them to see things his way led him to be regarded as one of our greatest Presidents. References A-E Networks. Ethics in The Criminal Justice Profession Essay example -- Morality/Et

Ethics or being ethical is simply based on a person’s capability to choose what is right or wrong or good or bad. Ethics can be defined as the body of moral principles or values governing or distinctive of a particular culture or group. (Banks C. , 2009). Ethics is a branch of philosophy dealing with the study of questions of right and wrong and how we ought to live our lives; A system of moral principles (Banks C. , 2009). Over all, morality rests squarely on the shoulders one’s early social environment. Ethics or being ethical in any business is very important. Business ethics, especially in retail, usually means three things, avoid breaking criminal law and labor laws, avoid action that may result in civil law suits against the company and avoid actions that are bad for the company image. Businesses are especially concerned with these three things given that it involves loss of money and company reputation. In theory, a business could address these concerns by assigning corporate attorneys and public relations experts to supervise employees on their daily activities. Because at anytime an employee might stray from acceptable conduct, the experts would be there to guide them back. Obviously, this solution would be a financial disaster if practiced. Given that it would cost a company more in attorney and public relations fees, companies save more by having preventative procedures in place. Consequently, companies have established special task forces or special departments to combat company from losses that it more cost effective. Such as, loss prevention agents or specialists, security guards and or special police, etc., to help prevent â€Å"shrinkage†. There are many major issues concerning criminal justice. These major issues ... ...ears, it is has come to light that some criminal justice professionals (decision makers) have sometimes fell short of making the â€Å"right† choices, or have deliberately acted unethically in carrying out their duties (Banks, 2009). Being ethical whether it’s in criminal justice or loss prevention it all has to do with making the right decisions to better the company or job. Works Cited Banks, C. (2009). Grave of the Fireflies

Tim Yang 4/2/13 JPN 211 During the Buffalo Film Seminar of Grave of the Fireflies by Isao Takahata, one can see World War II from the viewpoint and experiences of a Japanese survivor (Akiyuki Nosaka). The movie is about Seita, a sixteen years old boy, and Setsuko, his younger sister, and how they were forced to struggle in order to survive in the widespread famine and the heartless indifference of their extended family members and countrymen. Their mother died early in movie, after suffering burns and injuries from a firebombing related to the US B-29s and they were forced to live with their indifferent—inattentive aunt. After taking his aunt’s insults for some time, Seita finally decided that he had enough and left with Setsuko. They found an abandoned bomb shelter nearby and decided to live there by themselves with some money they took from the bank from their deceased mother. Once they ran out of money, Setsuko started to become extremely malnourished and sick; so as a way to cure Setsuko, Seita resorted to stealing crops from farmers. Soon after, Seita learned that Japan lost the war and that his father died, losing all morale, his only purpose in life left was to make sure his sister survives.Ultimately they both died, due to malnutrition and negligence of their countrymen. The movie shows how a society can become helpless and weak, and also fail to protect one another. Since the movie is a foreign film it also shows another perspective from a different culture and race. Grave of the Fireflies was beautiful made and it can bring better understanding, appreciation, and reflection upon the horrors of war and its aftermath as experienced by the Japanese people in WWII.

Family Is The Most Definitive And Sensible Definition Of...

Position Paper on Family Arais Farah 14194856 Family is comprised of a group of two or more individuals related by birth, marriage, and or adoption residing together in a household. Family is an social institution which functions in nurturing both emotionally and financially. This definition of family is the most definitive and sensible definition of family because it describes all aspects of family, and the emotional needs of everyone making up the family. Families that meet the description of my definition tend to be successful as a family. The definition also aligns itself to the common U.S laws of family and family rights. It is an advantageous definition because it outlines what a family not only is, but what it should be if it wants to be a successful family. I use the term success because a successful family is one that is emotionally and financially stable, with values and goals. A stable family is a united family. Now when you think about your traditional family, you assume a family is comprised of a heterosexual coupl e of husband and wife, two or three kids living in a traditional home. This traditional family is assumed to be able to carry out the tasks of family in providing financial and emotional support, teaching them the social skills to function out in society, and to respect external authority as well as maintaining authority and control within the family.
